Terms of Service

These Terms of Service ("Terms") govern your access to and use of the PeopleSafe safety management platform, including our web application, mobile worker portal, APIs, and related services (collectively, the "Service") provided by PeopleSafe Inc. ("PeopleSafe," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
  • Company administrators are responsible for managing team members, workers, and access permissions within their organization.
  • You must be at least 18 years old to use the Service.
  • Each company account is a separate tenant. You may not attempt to access data belonging to other organizations.

2. Subscription and Payment

  • Access to PeopleSafe requires a paid subscription. Pricing details are available on our pricing page.
  • Payments are processed securely through Stripe. We do not store your full credit card information.
  • Subscriptions are billed on a recurring basis (monthly or annually) and will auto-renew unless cancelled.
  • You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.
  • We reserve the right to change pricing with 30 days' written notice. Existing subscriptions will be honored until their next renewal date.
  • Refunds are handled on a case-by-case basis. Contact us at billing@peoplesafe.co for refund requests.

3. Acceptable Use

You agree not to:

  • Use the Service for any purpose other than workplace safety management.
  • Attempt to access data belonging to other organizations or users.
  • Reverse engineer, decompile, or attempt to extract the source code of the Service.
  • Use the Service to send spam, unsolicited messages, or messages unrelated to safety operations.
  • Upload malicious content, viruses, or harmful code.
  • Interfere with or disrupt the Service or its infrastructure.
  • Use the SMS capabilities for marketing, promotional, or non-safety-related messaging.
  • Share account credentials or allow unauthorized individuals to access the Service.
  • Submit false incident reports, fabricated safety data, or fraudulent OSHA records.

4. SMS Terms

By using the Service and providing worker phone numbers, you acknowledge and agree to the following SMS terms:

  • Company administrators are responsible for obtaining worker consent before adding their phone numbers to the system.
  • SMS messages are used exclusively for safety-related communications: training quizzes, safety reminders, incident alerts, certification notifications, and welcome messages.
  • Workers may opt out at any time by replying STOP to any message. Workers may opt back in by replying START.
  • PeopleSafe complies with TCPA (Telephone Consumer Protection Act) and CTIA messaging guidelines.
  • Message frequency varies based on your company's training schedule, typically 1-4 messages per week.
  • Standard message and data rates may apply.

5. Data Ownership and Responsibilities

5.1 Your Data

You retain ownership of all data you submit to the Service, including worker information, incident reports, forms, documents, and OSHA records. We do not claim ownership of your content.

5.2 License to Use Your Data

You grant PeopleSafe a limited, non-exclusive license to use, process, and store your data solely for the purpose of providing the Service. This includes processing data through AI models for quiz generation and safety analysis. We will not sell your data to third parties.

5.3 Data Accuracy

You are responsible for the accuracy of data entered into the Service, including worker information, incident reports, and OSHA records. PeopleSafe provides tools to help with OSHA compliance but does not guarantee that your use of the Service will satisfy all regulatory requirements. You remain responsible for your organization's compliance with applicable safety regulations.

6. OSHA Compliance Disclaimer

PeopleSafe provides tools to assist with OSHA recordkeeping and compliance, including:

  • Automated OSHA 300 Log, 300A Summary, and 301 Incident Report generation.
  • Recordability determination assistance based on OSHA criteria.
  • 7-day recording deadline tracking and alerts.
  • Privacy case handling per OSHA guidelines.

However: PeopleSafe is a tool to assist with compliance, not a substitute for professional safety counsel. The determination of OSHA recordability, the accuracy of injury classifications, and the completeness of regulatory filings remain the responsibility of your organization. We recommend consulting with qualified safety professionals for compliance questions.

7. AI-Generated Content

The Service uses artificial intelligence (Google Vertex AI) to generate safety training quizzes, incident analysis, and safety intelligence reports. You acknowledge that:

  • AI-generated content is intended to supplement, not replace, professional safety expertise.
  • Company administrators should review AI-generated quiz questions and analysis for accuracy before distribution.
  • PeopleSafe does not guarantee the accuracy or completeness of AI-generated safety recommendations.
  • Training content processed by AI models does not include personally identifiable worker information.

8. Service Availability

  • We strive to maintain high availability but do not guarantee uninterrupted access to the Service.
  • The Service includes offline capabilities for form submissions, which will sync automatically when connectivity is restored.
  • We may perform scheduled maintenance with reasonable advance notice.
  • SMS delivery depends on third-party carrier networks and is subject to carrier availability and reliability.

9. Intellectual Property

The Service, including its design, features, code, documentation, and branding, is owned by PeopleSafe and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable right to use the Service for your internal business purposes during the subscription term. You may not copy, modify, distribute, or create derivative works based on the Service.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • PEOPLESAFE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
  • WE DO NOT WARRANT THAT THE SERVICE WILL ENSURE WORKPLACE SAFETY OR FULL REGULATORY COMPLIANCE.
  • IN NO EVENT SHALL PEOPLESAFE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.
  • OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
  • PEOPLESAFE IS NOT LIABLE FOR WORKPLACE INCIDENTS, INJURIES, OR OSHA PENALTIES. THE SERVICE IS A MANAGEMENT TOOL, NOT A GUARANTEE OF SAFETY.

11. Indemnification

You agree to indemnify and hold harmless PeopleSafe, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) inaccurate data you submit to the Service; or (e) your failure to comply with OSHA or other safety regulations.

12. Termination

  • You may cancel your subscription at any time through your account settings.
  • We may suspend or terminate your account for violation of these Terms, non-payment, or as required by law.
  • Upon termination, you may request an export of your data within 30 days. After 30 days, we may delete your data, subject to legal retention requirements (such as OSHA recordkeeping obligations).
  • Sections regarding intellectual property, limitation of liability, indemnification, and governing law survive termination.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. For significant changes, we will provide at least 30 days' notice via email or through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
